What these terms cover
Terms of service are easy to skip. These are short enough to read, and they set out what you can expect from Omxus, what we ask of you, and how the law applies between us.
Omxus, said OHM-SHUSS with a soft "sh" like the x in pinyin, reads as Om, the sound of everything, times us. It's an account you use to sign in to many sites and apps. These terms cover that account and the sign-in service. They include:
By creating or using an Omxus account, you agree to these terms. Our Privacy Policy isn't part of these terms, but we encourage you to read it. It explains what we collect and how you control it.
Service provider
Omxus is provided by, and you're contracting with:
You must be at least {{MINIMUM_AGE}} years old to create an Omxus account, or older if the law where you live sets a higher age to agree to online services. If you're under the age where you live at which you can agree to a contract on your own, your parent or guardian must agree to these terms for you.
Sites that use Omxus can set their own, higher age requirements.
Your relationship with Omxus
These terms describe the relationship between you and {{LEGAL_ENTITY}}. When we say "Omxus", "we", "us" or "our", we mean {{LEGAL_ENTITY}}. We give you permission to use Omxus as long as you follow these terms.
What you can expect from us
A sign-in service you can rely on
Omxus gives you one account to sign in to the sites and apps that use it. We provide ways to sign in with a password, a passkey, a one-time code, or your name, date of birth and secret words, and tools to see where you're signed in, review your security activity, change your details, and delete your account.
Signing in with Omxus costs you nothing.
Improvements, and notice before big changes
We keep improving Omxus. Sometimes that means adding or removing features or ways to sign in, or changing limits. If we make a change that materially reduces what you can do with your account, or we stop offering Omxus, we'll tell you in reasonable time beforehand and give you the chance to get a copy of your information. We won't give notice first when a change is urgent, for example to stop abuse, fix a security problem, or meet a legal requirement.
What we expect from you
Follow these terms
Your permission to use Omxus lasts as long as you follow these terms. Our Help Centre, Privacy Policy and the messages on our sign-in screens help explain how Omxus works.
Respect others
When you use Omxus, you must:
follow the law,
respect other people's rights, including their privacy and their right to their own accounts,
not use a username to impersonate a person, a site, or Omxus, or to mislead people about who you are,
not choose a username that harasses, threatens or demeans anyone.
Don't misuse Omxus
Most people never come close to these rules. We list them so everyone knows where the lines are. You must not:
sign in, or try to sign in, to an account that isn't yours,
guess, collect or test passwords, codes or secret words,
try to find out which email addresses or mobile numbers have accounts,
create accounts automatically or in bulk, or create accounts to sell, trade or give away,
send floods of codes to anyone's email or mobile,
get around our limits, throttles or security checks,
interfere with or disrupt Omxus, the sites that use it, or the networks behind them, including with malware or excessive traffic,
build or run a page that imitates the Omxus sign-in to collect people's details,
copy, resell or reverse engineer Omxus to attack it or the people who use it, except where the law allows.
Tip
Found a security problem? We welcome reports made in good faith. Tell us with the security report form before telling anyone else, don't access or change other people's information, and give us reasonable time to fix it.
Your Omxus account
Keeping your account safe
You're responsible for what happens through your account, and for taking reasonable steps to keep it secure. That means:
keeping your password, passkeys and secret words to yourself,
keeping your email address or mobile number current and secure, because that's where your codes go,
telling us with the contact form if you believe someone else is using your account.
An Omxus account is for one person. Don't share it.
Your contact details
Give us an email address or mobile number that belongs to you and that you can use. Don't use someone else's without their permission.
If you lose access
We provide several ways to get back into your account, described in Get back into your account. To protect accounts from takeover, we don't move an account to a new email address or mobile number because someone asks us to.
Important
If you sign in with your name, date of birth and secret words, only those three things open that account. We never receive them, so we can't recover or reset them. Keep a safe record of your secret words.
Usernames
Usernames follow the rules in Choose or change your username. Your username isn't property you own, and you can't sell or transfer it. We may remove or change a username that breaks these terms, for example one that impersonates someone, and we'll tell you when we do.
Using Omxus on behalf of an organisation
An Omxus account belongs to a person. If a site or organisation asks you to use Omxus for work, these terms still apply between you and us, and the organisation's own rules apply between you and it.
Sites and apps that use Omxus
Sites and apps that offer Omxus sign-in are run by other people and organisations, not by Omxus.
Their service, their terms. Each site's own terms and privacy policy apply to what you do on it. Read them before you sign up.
Their decisions. A site decides what you can do there, including whether you need to verify your email or mobile, and whether to block your account on its service.
Their content. We don't control, and aren't responsible for, what a site offers, sells or shows.
What you share. When you sign in, we give the site the details described in our Privacy Policy. After that, the site's privacy policy covers them.
Separate accounts. Deleting your Omxus account doesn't delete your account or content on a site, and a site closing your account there doesn't affect your Omxus account.
Content and software
Your content
The only content you give Omxus is your username. It stays yours. You give Omxus permission to store your username and show it to the sites you sign in to, only to run the service. This permission is worldwide and free, and it ends when you change your username or delete your account, except for copies sites already hold.
Omxus content and marks
The Omxus name, the Omxus ring, the round sign-in button and our other marks belong to {{LEGAL_ENTITY}}. Don't remove, hide or change them on our sign-in screens, and don't use them in a way that suggests we endorse you or your site.
Software
Some parts of Omxus run in your browser or on your device, like the sign-in screen. We give you a personal, worldwide, free, non-exclusive and non-transferable permission to use that software as part of Omxus. Where we publish software under an open source licence, that licence's terms apply to it and can override parts of this section.
Using Omxus
Messages from Omxus
To provide the service, we send you codes and important notices about your account, and tell you about significant changes to these terms or our Privacy Policy. These messages are part of the service, so you can't turn them off while you have an account. We don't send marketing.
If you send us feedback or suggestions, we may use them without any obligation to you.
Mobile and data costs
If you get codes by text, your mobile provider's standard rates for receiving texts may apply. Using Omxus uses your internet connection, and your provider's charges for data apply. You're responsible for those costs.
In case of problems or disagreements
Both the law and these terms give you the right to a service of a certain quality, and ways to fix things when they go wrong.
Your rights under Australian Consumer Law
If you're a consumer, the Australian Consumer Law gives you guarantees that can't be excluded, including that we provide our services with due care and skill. Nothing in these terms limits those guarantees or any other right you have under a law that can't be excluded by contract. Consumers in other countries keep the protections their local laws give them in the same way.
Our commitment
We provide Omxus using reasonable care and skill. If we don't, tell us with the contact form and we'll work with you to fix it.
Disclaimers
Beyond the commitment above and the rights the law gives you, we provide Omxus as it is. We can't promise that Omxus will always be available or free of errors, or that a particular site will keep offering it. Omxus signs you in to sites. It doesn't check, and we don't vouch for, what a site does.
Liability
For everyone
These terms only limit our responsibilities as far as the law allows. They don't limit our liability for fraud, for death or personal injury caused by our negligence, or for anything else the law doesn't let us limit.
Limits
Subject to the section above and your rights under Australian Consumer Law:
we're not liable for losses a site causes you, or for content or services on a site,
we're not liable for losses that come from someone using your password, codes, passkeys or secret words, unless our failure to take reasonable care caused it,
for business users, we're not liable for lost profits, revenue, business opportunities or goodwill, or for indirect or consequential loss,
where our liability for failing to meet a consumer guarantee can lawfully be limited, it's limited to supplying the service again or paying the cost of having it supplied again,
otherwise, our total liability arising out of these terms is limited to {{LIABILITY_CAP}}.
For business users
If you use Omxus for a business, to the extent the law allows you'll indemnify {{LEGAL_ENTITY}} and its officers and staff against third-party legal claims arising from your unlawful use of Omxus or your breach of these terms, except to the extent our breach, negligence or wilful misconduct caused them.
Taking action in case of problems
Before we act as described below, we'll give you notice when reasonably possible, explain why, and give you a chance to fix the problem, unless we reasonably believe doing so would harm someone, break the law or a legal order, compromise an investigation, or compromise the security of Omxus or the people who use it.
Turning off your account
We may turn off your account, or end it, if:
you seriously or repeatedly break these terms,
the law or a court order requires it,
we reasonably believe your account is causing harm to someone, to a site or to Omxus, for example through account takeover, fraud, harassment or attacks on the service,
we reasonably believe someone else has taken over your account, to protect you.
Turning off an account signs it out everywhere without deleting it. If you think we turned off your account by mistake, send us a message and we'll review it.
Your right to leave
You can stop using Omxus and delete your account at any time. We'd like to know why, so we can improve, but you don't have to tell us.
Settling disputes, governing law and courts
If you have a problem with Omxus, contact us first with the contact form. Most issues can be resolved quickly that way.
The laws of Western Australia, Australia, govern these terms and any dispute arising from them or from Omxus. Disputes are resolved in the courts of Western Australia, and courts that can hear appeals from them, and you and we agree to their jurisdiction.
If you're a consumer living in another country whose laws give you the right to bring a dispute in your local courts, or to rely on your local laws, these terms don't take that right away.
About these terms
By law, you have rights that a contract like these terms can't limit. These terms don't try to.
These terms describe the relationship between you and {{LEGAL_ENTITY}}. They don't create legal rights for anyone else.
If a part of these terms turns out to be invalid or unenforceable, the rest stays in effect.
If you don't follow these terms and we don't act straight away, we haven't given up any rights, such as acting later.
We may update these terms to reflect changes in Omxus or how we operate it, for legal, regulatory or security reasons, or to prevent abuse. If we change them in a way that materially affects you, we'll tell you in reasonable time before the change takes effect, except when we launch a new feature or when a change is urgent, such as stopping ongoing abuse or meeting a legal requirement. If you don't agree to the new terms, stop using Omxus and delete your account.
Definitions
Business user
A person or organisation using Omxus in the course of a trade or business, who isn't a consumer.
Consumer
A person using Omxus for personal, domestic or household purposes, or anyone else the law where they live treats as a consumer.
Disclaimer
A statement that limits someone's legal responsibilities.
Indemnify
A promise to cover another person's losses from legal claims made against them.
Liability
Losses from any kind of legal claim, whether based on a contract, negligence or anything else, and whether or not those losses could have been foreseen.
Omxus
Said OHM-SHUSS. The Omxus account and sign-in service, including the sign-in screens, the Omxus sign-in page at auth.omxus.com, the Help Centre, and the software that runs them.
Passkey
A sign-in key your device makes for one website and unlocks with your fingerprint, face or PIN.
Site
A website or app, run by someone other than Omxus, that uses Omxus for signing in.
Username
The name you choose that sites show for your account, shared across sites that share usernames or specific to one site.
Your account
Your Omxus account, and everything Omxus stores for it, as our Privacy Policy describes.
